It’s time to spell out to public sector employees the responsibilities of public office, as well as providing them with a lifeline of support against bullying managers and employers. The objective is to create an independent support framework for whistleblowers.

It is your legal duty as a public officer to help to stamp out malpractice and corruption within public services. It is a criminal offence to take action or knowingly disregard information available to you in circumstances where you have reasonable grounds to believe that physical, psychological or financial harm may be caused. Your wider legal duty of care overrides any statutory process within your organisation and any instruction from your employer.
A public officer who wilfully neglects to perform his/her duty and/or wilfully misconducts him/herself to such a degree as to amount to an abuse of the public’s trust in the office holder, risks prosecution for ‘Misconduct in Public Office’. This includes ignoring malpractice. The offence carries a maximum sentence of life imprisonment.
You must report as soon as possible any concerns that you may have to a body independent of your employer. You may contact firstname.lastname@example.org with details of your concerns which will be added to a time/date stamped log that can be referenced by you in any future dispute. An anonymised copy of the log will be sent to ministers. The involved agencies will be held to account.
